RANDOM FARMS STANDARD AGREEMENT AND PARTICIPATION POLICY

AUTHORIZED SIGNER: I represent that I am (i) a parent or legal guardian (“parent” for this agreement) of a child (“participant” or “my child” for this agreement), or (ii) I am age 18 or older at the time of signing this agreement and am registering myself (“adult child” for this agreement).

RELEASE OF LIABILITY AND INDEMNIFICATION: I and my child each agree to waive, release and hold harmless Random Farms Kids’ Theater (RFKT) and its directors, officers, employees, volunteers, interns, agents, and operating personnel from all claims in connection with my or my child’s participation in any RFKT activity, except claims arising from RFKT’s own gross negligence. I agree to indemnify, hold harmless and, at RFKT’s option, defend, RFKT from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys' fees and costs, arising out of or relating to my, my family and my child’s participation in any RFKT activity.

SAFETY AND EMERGENCY: In the event of an emergency, RFKT attempts to contact parents. However, if RFKT is unable to contact those listed as my child’s Emergency Contact, I consent to emergency medical treatment as arranged by RFKT.

ONLINE AUTHORIZATION: I agree that my electronic signature and any agreement or representation made online, by me, my spouse, or my child which required the provision at some point in time of my electronic signature, legally binds me as much as my handwritten signature.

PAYMENTS AND PARTICIPATION: I agree, and hereby authorize, RFKT to charge my credit card for all amounts as they come due under this agreement, including when due under a Payment Plan. I agree that, if I owe an overdue balance for another RFKT program, neither I nor my child(ren) may participate in any RFKT activity until all outstanding balances have been paid in full. I agree that my registration fee pays for the opportunity for my child to participate in the program but, if my account is placed On Hold, does not guarantee that my child will be able to complete the program.

SCHOLARSHIP: I agree that scholarships are only available if my child complies with all Participation Policies and completes the entire program for which the scholarship was offered. If my child violates an RFKT Participation Policy or is otherwise unable to participate in an activity, I agree that I am liable for $150 of the value of the scholarship.

PAYMENT PLAN: If I have been authorized to pay on a payment plan, I need not make immediate payment in full, but must, on a schedule of my choice, login and authorize payments such that RFKT receives payment in full by 11:59pm on the day (“Payment Date”) before any of the following: (i) the first dress rehearsal, or (iii) the Payment Date as specified. I agree that I am responsible for any balance due as of the Payment Date, or, if my child violates a Participation Policy, any balance due as of the date of the violation.

ON HOLD ACCOUNTS: RKFT reserves the right to place an account On Hold when I, any family member or agent, or any child associated with my account, breaches this agreement, including violations to RFKT’s Anti-Bullying Policy (as defined below), interference with RFKT’s Creative Learning Environment (as defined below), damages to RFKT property, or failure to pay an outstanding balance. I agree that while my account is On Hold, (i) any child associated with my account may be dismissed from current activities, without refund and (ii) I will not be able register any child associated with my account for future activities, either through my account or another account. If the sole reason an account is On Hold is because of outstanding balances, payment in full removes an account from being On Hold. If an account is On Hold for any other reason, removing an account from being On Hold is at the sole discretion of RFKT. If I register a child in violation of my account being On Hold, RFKT will cancel the registration.

PROPERTY DAMAGE: I agree that I am responsible, any damage to any RFKT property caused by me, my child(ren), or agent. I further agree, and hereby authorize RFKT, to either charge my credit card (if already on file), or provide payment, in the amount RFKT reasonably calculates as the full replacement cost. RFKT property includes costumes and any property for which RFKT is responsible, whether or not owned by RFKT, such as venue property and rented props. Further, I agree that RFKT may put my account On Hold, at any time, if RFKT is unable to collect payment for property loss or damage.

PARTICIPATION POLICY: Each RFKT activity has its own Participation Policy, which is hereby incorporated into this agreement. I agree that failure to comply with the Participation Policy results in my account being placed On Hold. Participation Policies use the following definitions:

ILLNESS POLICY: For the protection of your child, other children, and RFKT staff, please observe the following rules if your child is ill: (i) in the case of a fever, do not allow your child to attend or participate in a rehearsal, a performance, or a class or lesson until at least 48 hours after your child’s temperature has returned to normal; and (ii) if your child has vomited, to prevent the spread of gastrointestinal viruses, do not allow your child to attend or participate in a rehearsal, a performance, or a class or lesson until they have not vomited for at least 24 hours. If, during a performance, rehearsal, class or lesson, RFKT staff observes a child looking or feeling ill, the RFKT staff, in its sole discretion, shall determine if the child is well enough to participate and may remove the child from the activity. 

CANCELLED OR RESCHEDULED EVENTS / REHEARSALS / PERFORMANCES: There are no refunds or credits for rehearsals, performances, or events that need to be cancelled or rescheduled, due to inclement weather, venue conflicts, or other reasons.

CREATIVE LEARNING ENVIRONMENT: RKFT is committed to providing a creative learning environment beneficial to the support and growth of everyone. As such, RFKT does not tolerate any of the following and any child, or their parent, family or agent, engaging in any of the following will result in the child’s dismissal from the current program, without refund, and the account will be put On Hold: Physical aggression towards any other person; refusal to participate (i.e. wear assigned costume, follow directions, etc.); inability to pay attention or focus; disruptive behavior; verbally abusive or threatening towards any other person; inability to stay in rehearsal room or performance venue without parent; requires continuous one-on-one or disproportionate attention from staff; causes harm, or threatens to cause harm, to self, others or property of RFKT or another; is not potty-trained; using or selling cigarettes or alcohol or illegal drugs at rehearsal or performance venues; violence; vandalism; threatening behavior (physical or emotional); sexual misconduct.

ANTI-BULLYING POLICY: RFKT does not tolerate bullying of any kind, by either a child or a child’s parents, family members or agent. This applies to bullying directed towards another member of the RFKT community, be it physical, verbal or cyber-bullying, associated with an RFKT event or performance or individual.

REFUNDS: I agree that RFKT does not offer refunds or credits, including failure to comply with an RFKT Participation Policy, sickness, family emergencies or other reasons. If the program changes into a format that registrants are not comfortable with, withdrawal from the program before it starts will be possible with a full credit or refund. 

DISPUTE RESOLUTION: I agree to pay all of RFKT’s costs, fees and incidentals incurred by RFKT in enforcing this agreement, which I agree shall be part of any judgment in RFKT’s favor against me. I agree RFKT may sue me and any agent in the same action.

PHOTOGRAPHS AND VIDEO: I grant to RFKT the right to use and reproduce any photograph, video, sound recording or other copyrighted material containing me and my child(ren), or any likenesses thereof, including our names, while participating in, preparing for, or otherwise associated with any RFKT activity, for any lawful purpose consistent with the operation of a quality children’s theater. This grant applies regardless of the author of the copyrighted material. I agree that reproductions of such copyrighted material, and derivatives thereof, are owned only by RFKT, which may retouch, modify or associate such copyrighted material as it sees fit without further authorization from me. I waive any claim against RFKT by me and my child(ren) for any violation of any privacy or proprietary rights associated with such copyrighted material.

SEVERABILITY: If any provision of this agreement is held unenforceable, such provision shall be deemed not part of this agreement, and the remaining provisions shall constitute the entire agreement, which shall remain valid and in full force and effect.

PARTICIPATION POLICY

PRIVATE VOICE AND ACTING LESSONS:  Lesson cancellations must be communicated to the instructor via email at least 24 hours before the scheduled lesson time or the student will be charged for the cancelled lesson.
